Some school board members have voiced frustration over the lack of guidance from the Florida Department of Health's Dr. Raul Pino. Teachers are also frustrated with the entire situation. Taylirre Mack is an Orange County parent and teacher. She thinks going back to school is not safe. "Anybody who's supporting brick and mortar schools opening right now is basically saying I'm okay with sending kids and teachers to die, because that's what's going to happen, " Mack said. But the state ordered all school districts to come up with a back-to-school plan that includes physical classroom instruction. If they don't do that, they could lose millions in funding. Mack says no amount of school funding is worth putting her loved one's lives at risk. "It's not my life I'm concerned about, it's my grandmother's, it's my daughter's life – it's all the things I'd be spreading around because I'd be pushed into a school, " Mack said.

That lawsuit, brought by a county teacher and a county parent, claims that it is unsafe to open schools and that Florida's order forced the Orange school district to devise an August opening plan under threat of losing state funding. The case is scheduled to be heard Aug. 13, with the plaintiffs looking to call Gov. Ron DeSantis and Corcoran as witnesses. DeSantis has said local officials have flexibility to set their reopening date but has not made it clear if he meant they could open later than August. Many Florida school districts had planned to start the 2020-21 school year on Aug. 10 but have since pushed their first day of school back later in the month. Corcoran, who issued the order, was asked to rescind the five-day-a-week part of his order July 15 by a member of the State Board of Education, and he refused, saying parents should be able to have their children back in school, if they wanted. "They absolutely should have that option, and it will not come out of the emergency order, " Corcoran said, speaking at the State Board of Education meeting in Hillsborough County.
"The Governor has said over and over again that it is schools re-opening is a local decision, " said Taryn Fenske in an email. The order was meant to help districts get funding for new "innovative" options and allowed them to "decide when to open schools based on local health metrics, " she wrote. The order says, "Upon reopening in August, all school boards.... must open brick and mortar schools at least five days per week for all students, subject to advice and orders of the Florida Department of Health, local departments of health, Executive Order 20-149 and subsequent executive orders. Absent these directives, the day-to-day decision to open or close a school must always rest locally with the board. " Education Commissioner Richard Corcoran issued the order the same day President Donald Trump tweeted, "SCHOOLS MUST OPEN IN THE FALL!!! " Wells, the attorney who sent the letter, is representing the state education department in the Orange lawsuit filed July 19 that challenges the state's school reopening order.
